ICJ decision on Jadhav a victory for rule of law: Arun Jaitley

Describing the ICJ verdict as a major victory for India and also a victory for justice and human rights, Mengal said, "The Pakistani government, intelligence agencies and the Army have been carrying atrocities and acts of genocide against the Baloch people".

Sushma Swaraj said that ICJ order has come as great relief to family of Jadhav and thanked Harish Salve for presenting India's case effectively.

"It is appropriate for the court to order that Pakistan take all measures at its disposal to ensure Mr Jadhav is not executed before this (11-member) court has given its final decision", presiding Judge Ronny Abraham said.

It also noted the urgency of the case since Pakistan had given "no assurance that Mr Jadhav will not be executed before the court has rendered its final decision". In this case, India and Pakistan both differ on the question of India's consular assistance to Jadhav under the Vienna Convention.

In its interim order on Thursday, the United Nations court agreed that Pakistan had violated the Vienna Convention.

"India has the right to seek consular access for Jadhav", he added.

"The real face of India will be exposed before the world", Foreign Office spokesperson Nafees Zakaria said.

The interim order issued on Thursday is nominally binding, but there have been cases in the past when countries have disregarded such stays of execution.

Last week, after India challenged the death sentence, Pakistan was asked by the International Court to put it on hold.

Deadline for Indian spy Kulbhushan Jadhav to file an appeal against his death sentence, which was awarded by an military court, is ending today (Friday), Samaa news reported.

A Pakistani military court sentenced him to death in April.

However, he said Pakistan “will present solid evidence against the Indian spy in the International Court.”.

In 1998, a Paraguayan man was executed for murder in Virginia despite the worldwide court's order urging the United States to halt his execution in a similar case involving the right to consular access.

India has appealed to the world court that Pakistan did not heed an global treaty that granted diplomatic immunity to foreign nationals charged with capital crimes.

Since Jadhav's arrest in 2016, Pakistan has rejected 16 Indian requests for consular access.

"In our submissions on 15 May, we had assured the court unambiguously that Commander Jadhav would be provided every opportunity and remedy available under the law to defend his case", a statement said.

A former Indian navy officer-turned-businessman, Jadhav was kidnapped from Iran previous year and arrested by Pakistan on espionage charges on March 3, 2016.

Jadhav's case is the latest flash-point in the tensions between Pakistan and India.
